Supreme Court rules public can sue police

A Supreme Court of Canada ruling could change the way police forces
around the country conduct their investigations.
On Thursday, the court ruled 6-3 that police officers and forces can be
sued for negligence.
Writing for the majority position, Chief Justice Beverley
McLachlin stated that "police are not immune from liability under the law of
negligence ... Police officers owe a duty of care to suspects."
The ruling went on to state that investigation standards
must be measured against how a "reasonable officer" would act under similar
circumstances.
"Police officers may be accountable for harm resulting to a
suspect if they fail to meet this standard," according to the ruling.
But court unanimously disagreed with the specific claim of
negligence made by a Hamilton man who brought the case before Canada's
highest court. Jason George Hill said he was wrongfully prosecuted,
convicted, and imprisoned because of a negligent police investigation. He
spent 20 months in jail before his conviction for a bank robbery was
overturned and another man arrested for a series of heists originally
attributed to Hill.
The court noted that what happened to Hill did not amount to
negligence, but that unfortunately he was a victim of an "unfortunate series
of events." The court also agreed with lower court rulings and noted that
Hill, who was identified by witnesses, resembled the actual thief.
Hill's civil suit had claimed $3 million in damages.
Despite the defeat of Hill's suit, the ruling is a setback
for the Ontario and federal governments who had argued that allowing
lawsuits against police would have a chilling effect on the law enforcement
community.
Three dissenting judges also disagreed with their colleagues.
They wrote that "A private duty of care owed by the police
to suspects would necessarily conflict with an officer's overarching public
duty to investigate crime and apprehend offenders."
But the majority noted that the ruling would not send a "chill"
throughout law enforcement, and that not every wrongful act by police could
end up in court.
"The law of negligence does not demand a perfect
investigation. It requires only that police conducting an investigation act
reasonably,'' stated the majority ruling.

Hellooo? Did
you hear that people? So does this mean that false accusations that lead
to the charging, arrest, assault and imprisonment of a Father or married
man with no children as a result of false accusation and subsequent police
action can lead to the police being sued? IS that the way it looks? What
about parallel damages? What about the false accuser? What about a lot of
things? What does it all mean? Watch this space. We are going to find out.
We will keep you posted. I wouldn't trust the Supreme Court and McLaughlin
as far as I could spit but it bears checking out. And if its all true then I
think we should sue the pants off them. If we are able to.

CRUCES -- A 30-year-old Las Cruces woman was in custody Wednesday,
charged with having sexual contact with an 8-year-old boy, Las Cruces
police reported.
Michelle A. Tufts, 30, of the 2800 block of east Idaho Avenue, was
arrested Monday and is charged with two felony counts of criminal
sexual penetration of a child younger than 13 and one count of
contributing to the delinquency of a minor.
Last week, the boy's grandmother notified police that Tufts might
be having an inappropriate physical relationship with the boy, Las
Cruces Police Department spokesman Dan Trujillo said.
Police detectives investigated the reports and concluded the
allegations were accurate, Trujillo said.
Tufts is being held at the Doña Ana County Detention Center, and
her bond is set at $50,000.

Dans le tableau A.1, on constate que
les travailleurs masculins passent en moyenne presque autant de temps que
les femmes en compagnie des membres de leur famille lors d’une journée de
travail typique. Cette absence de différence se confirme d’ailleurs dans
plusieurs sous-groupes de la population des travailleurs. En effet, mis à
part le clivage entre les hommes et les femmes selon la structure de leur
ménage (en particulier la présence d’enfants, qui a une incidence plus
forte sur le temps passé en famille pour les femmes), des analyses
supplémentaires n’ont pas permis de découvrir de différences entre les
travailleurs et les travailleuses selon leur âge, leur région de résidence
ou leur niveau de scolarité. À titre d’exemple, en maintenant les autres
facteurs constants, les hommes âgés entre 30 et
34 ans ne passaient ni plus ni moins de temps en compagnie des membres de
leur famille que les femmes du même groupe d’âge.
La même chose se confi rme en ce qui a trait à l’association entre la
durée de la journée de travail et le temps passé en famille; en maintenant
constant tous les facteurs inclus dans le modèle 4 et en procédant aux
comparaisons selon le sexe, la durée moyenne de temps passé avec la
famille par une femme ayant travaillé durant 9 heures, Qu’en est-il des
différences entre hommes et femmes? TSC par exemple, était la même que
celle d’un homme ayant travaillé le même nombre d’heures.
La seule exception concerne les
femmes ayant travaillé entre 3 et 5 heures comparativement aux hommes
ayant travaillé le même nombre d’heures. On sait
que c’est dans ce sous-groupe que la durée prédite de temps passé en
compagnie des membres de la famille augmente le plus (le modèle 4 prédit
une augmentation d’environ 2 heures passées en famille pour ce groupe de
travailleurs par rapport au groupe de ceux ayant travaillé entre 7 et
moins de 8 heures durant la journée). À la lumière de l’analyse
supplémentaire comparant les travailleurs selon leur sexe,
les femmes qui ont travaillé entre 3 et 5 heures durant la
journée avaient une durée prédite de temps passé avec les membres de la
famille de 34 minutes de moins que les hommes
(en maintenant les autres facteurs constants). Il est
néanmoins diffi cile d’en expliquer les raisons.
En résumé, à part la présence
d’enfants chez les travailleurs vivant en couple,
la presque totalité des variables qui se sont montrées
corrélées au temps passé en famille avaient la même incidence chez les
hommes et les femmes.
