Pensez-y!

The Foster Care Council of Canada

Former foster child turned child-welfare reform advocate, John Dunn, has charged the Children's Aid Society of Ottawa and its Executive Director, Barbara MacKinnon under the Corporations Act, R.S.O. 1990, c. C-38, for committing Offences while stonewalling Dunn's attempts to advocate for the rights of children and youth in foster care.

Children's Aid Societies in Ontario are incorporated under the Corporations Act, R.S.O. 1990, c. C-38. As such, they are non-share capital corporations which means they have members instead of shareholders, but their functions are somewhat similar in that the corporation reports to the membership and the membership holds the corporation accountable through election of board members and other means available to members.

Dunn attempted to obtain a list of the Children's Aid Society of Ottawa's members list as allowed under section 307 (1) of Ontario's Corporations Act so that he could write a letter of advocacy to the members seeking to have them vote for a change to the Society's by-laws which would allow all children and youth who are direct clients of the Society to automatically become members of the Society as a means of strengthening their voices regarding the services they receive from the corporation, something which is inline with the spirit of article 12 of the United Nations Convention on the Rights of the Child (UNCRC), an international convention Canada has been a signatory for over eighteen years.

Article 12 of the UNCRC gives children the right to have a say in what they think should happen when adults are making decisions which affect their lives and to have their opinions taken into account.

When Dunn submitted his request for a list of the members of the Society in accordance with section 307 of the Act, the Society refused to furnish the list, which is a Provincial Offence.

After almost six months of trying to communicate with the Society to try and determine why the Society had refused to furnish the list of its members, Dunn was left with no other option than to lay a charge against the Society.

Not only did the Society refuse to furnish the list, they also used tax payers dollars (Societies are 100% funded by the Provincial Government) to hire an external law firm to assist them in committing the Offence of failing to furnish the list of their members.

Dunn also requested a list of the Catholic Children's Aid Society of Toronto's members using the same method, only to receive a letter from a Bay Street law firm (at tax payers expense) to refuse the list as well.
Recently in an interview with a Hamilton, Ontario news station, Peter Kormos, an Ontario MPP said that Children's Aid Societies in Ontario are "out of control" that there is "absolutly no accountability what-so-ever" and that "it's time to shut it down, the Government should be directly delivering child protection services".

Currently, the Children's Aid Society of Ottawa and its Executive Director have asked Dunn to enter into resolution discussions in an attempt to avoid the charges.

Dunn, only seeking the best interests of Ottawa's children and youth in care agreed and is currently awaiting an already drafted copy of the resolution proposal from the Defence Counsel.

The resolution proposal will create a protocol between Dunn and the Society which will ensure that any time Dunn has concerns about the well-being of Ottawa's children and youth in care, he will have a written agreement from the Society which will ensure that the Society acts in good faith when dealing with him rather than stonewalling him.

Should the Society not act in good faith when dealing with Dunn in his efforts to advocate for the well-being of children and youth in care, the agreement will have been breached opening the Society to possible charges yet again.
